Aviso de Privacidad 

  1. IDENTIDAD Y DOMICILIO DEL RESPONSABLE.

De conformidad con lo dispuesto por la Ley Federal de Protección de Datos Personales en Posesión de los Particulares (en adelante, la “Ley de Datos”), su Reglamento, los Lineamientos del Aviso de Privacidad y demás disposiciones aplicables al tratamiento de datos personales, se hace de su conocimiento el presente aviso de privacidad (el “Aviso de Privacidad”).

Galca Energy S.A.P.I de C.V. subsidiarias y filiales (en adelante “GALCA ENERGY” o “Responsable”) con domicilio en Hegel 512, colonia Polanco IV sección, alcaldía Miguel Hidalgo, Ciudad de México, C.P. 11560 como responsable del tratamiento de sus datos personales reitera el compromiso con la transparencia, seguridad y privacidad de los datos personales.

Cualquier información concerniente a una persona identificada o identificable al ser recopilada se tratará de acuerdo con los principios de licitud, consentimiento, calidad, finalidad, información, proporcionalidad, lealtad y responsabilidad.

  1. DATOS PERSONALES RECABADOS

GALCA ENERGY para llevar a cabo las finalidades que se enlistan en la sección IV y V del presente Aviso de Privacidad, recabaremos los siguientes datos personales:

  1. Nombre completo
  2. Teléfono de contacto fijo y/o móvil
  3. Correo electrónico

Los datos personales recabados se pueden reproducir en archivos electrónicos y archivos físicos.

Conforme al presente Aviso de Privacidad, la Sociedad no recabará datos personales sensibles, financieros o patrimoniales.

  1. FINALIDADES DEL TRATAMIENTO DE DATOS PERSONALES

GALCA ENERGY podrá utilizar sus datos personales para cumplir con diversas finalidades, , siendo las siguientes:

 

  1. Atención al cliente, posibles clientes y/o proveedores de solicitudes generadas por éstos.
  2. Realización de reportes internos requeridos de conformidad con el objeto y finalidad de GALCA ENERGY.
  3. Informar sobre cambios en los servicios ofrecidos por GALCA ENERGY.
  4. Crear bases de datos para fines administrativos, de organización, proyecciones de negocio, así como cumplimiento normativo.
  5. Atender y dar seguimiento a cualquier queja, pregunta, comentario, devolución, o solicitud de contacto que nos realice.
  6. Enviarle notificaciones de cambios a este Aviso

 

  1. FINALIDADES SECUNDARIAS DEL TRATAMIENTO DE DATOS PERSONALES 

De manera adicional, GALCA ENERGY podrá tratar sus datos personales para llevar a cabo alguna o todas las finalidades secundarias que se mencionan a continuación, mismas que nos permiten brindarle un mejor servicio:

 

  1. Enviarle información de carácter publicitario, promocional y/o informativo y prospección comercial de carácter personalizado de GALCA ENERGY de acuerdo con sus intereses y preferencias de consumo, así ́ como de otras marcas y/o denominaciones comerciales incluyendo el envío de comunicaciones a través de correos electrónicos, llamadas telefónicas, mensajes cortos, y demás medios de comunicación físicos, electrónicos y/o digitales;
  2. Realizar estadísticas, encuestas sobre consumo y de mercado;
  3. Invitarlo, conforme a las bases de oferta, a participar en licitaciones con relación a servicios, desarrollos y proyectos y contactarlo a través de distintos medios de comunicación físicos, electrónicos y/o digitales. Le informamos que, en el caso de que usted participe en dichas actividades, podrá ser necesario que GALCA ENERGY trate su imagen personal a través de videos y/o fotografías, para su publicación, a través de distintos medios de difusión físicos, electrónicos y/o digitales.

Envío de notas informativas de temas relacionados con la industria energética, así como novedades y actualizaciones legislativas en la materia.

  1. DERECHOS ARCO 

Como titular de sus datos personales, usted puede ejercer en cualquier momento los derechos de acceso, rectificación, cancelación y oposición (en adelante “Derechos ARCO”). Es importante mencionarle que el ejercicio de cada uno de estos derechos es independiente entre sí, es decir; no es necesario agotar uno para ejercer alguno de los otros.

  1. Derecho de Acceso. Ejercitando este derecho podrá conocer la información relativa al tratamiento que llevamos a cabo sobre sus datos personales.
  2. Derecho de Rectificación. Puede corregir o modificar sus datos en caso de que resulten inexactos o incompletos para garantizar que la información que podamos tener de usted es correcta.
  3. Derecho de Cancelación. Podrá solicitar la supresión de sus datos personales cuando concurra alguno de los supuestos contemplados. Por ejemplo, tratamiento ilícito de datos, o cuando haya desaparecido la finalidad que motivó el tratamiento o recogida. No obstante, se regulan una serie de excepciones en las que no procederá este derecho.
  4. Derecho de Oposición. Mediante este derecho podrá oponerse al tratamiento de sus datos personales: (i) cuando por motivos relacionados con su situación personal, debe cesar el tratamiento de sus datos salvo que se acredite un interés legítimo, o sea necesario para el ejercicio o defensa de reclamaciones, o bien, (ii) cuando el tratamiento tenga por objeto la mercadotecnia directa.
  5. Derecho de limitación del tratamiento. Podrá solicitarnos que limitemos el tratamiento de sus datos al tratarlos (i) cuando se impugne la exactitud de los datos, mientras verificamos dicha impugnación; (ii) cuando el tratamiento es ilícito, pero se oponga a la supresión de sus datos y solicite la limitación del tratamiento en su lugar (iii) cuando sea usted quien los necesite en caso de una reclamación (iv) e incluso cuando se hayas opuesto al tratamiento de sus datos para el cumplimiento de una obligación en interés público o para la satisfacción de un interés legítimo, que deberá verificarse. En estos casos únicamente los conservaremos para el ejercicio o la defensa de reclamaciones.

 

Para el ejercicio de sus Derechos ARCO, deberá presentar una solicitud (en adelante, la “Solicitud ARCO”), a GALCA ENERGY, a la atención del Oficial de Privacidad, a la siguiente dirección de correo electrónico victor.vazquez@galcaenergy.com para su atención y seguimiento acompañada de la siguiente información, documentación y especificaciones:

  1. La solicitud deberá llenarse en todos sus campos claramente y con letra de molde.
  2. Su nombre, domicilio y correo electrónico para poder comunicarle la respuesta a la Solicitud ARCO;
  3. Una copia de los documentos que acrediten su identidad (copia de INE, pasaporte o cualquier otra identificación oficial) o en su caso, los documentos que acrediten su representación legal;
  4. Una descripción clara y precisa de los Datos Personales respecto de los cuales busca ejercer alguno de los Derechos ARCO;
  5. Cualquier documento o información que facilite la localización de sus Datos Personales,
  6. En caso de solicitar una rectificación de sus Datos Personales, deberá de indicar también, las modificaciones a realizarse y aportar la documentación que sustente su petición.
  7. Si la solicitud se presenta a través de un representante, se deberá incluir el poder en el que consten las facultades otorgadas para este trámite, o bien, la carta poder firmada con dos testigos y la firma de aceptación del representante, debiendo incluir el nombre, firma, domicilio y copia fotostática de la identificación oficial de cada uno de los firmantes.

El Oficial de Privacidad responderá su Solicitud ARCO, indicando los motivos de su decisión mediante un correo electrónico en un plazo máximo de 20 (veinte) días naturales contados desde el día en que se haya recibido su Solicitud ARCO. En caso de que la Solicitud ARCO se conteste de manera afirmativa o procedente, los cambios solicitados se harán en un plazo máximo de 15 (quince) días naturales. En caso de que usted solicite el acceso a sus Datos Personales, GALCA ENERGY le informará mediante el correo electrónico en el que comuniquemos nuestra respuesta a su solicitud, el medio por el cual se le dará acceso a su información en caso de ser procedente. En caso de ser necesario y por única ocasión, GALCA ENERGY podrá notificar la prórroga de los plazos referidos en este por un periodo igual al original.

GALCA ENERGY podrá negar (en adelante, la “Negativa”) para que usted ejerza sus Derechos ARCO de acuerdo al artículo 34 de la Ley de Datos, de cualquier manera, el Oficial de Privacidad se obliga a informarle a usted el motivo de tal decisión.

 

La Negativa podrá ser parcial, en cuyo caso GALCA ENERGY efectuará el acceso, rectificación, cancelación u oposición en la parte procedente.

En caso que considere que hemos tratado sus datos de forma inadecuada no acorde a la normativa en materia de tratamiento de datos de carácter personal o no estés conforme en cómo hemos atendido el ejercicio de sus derechos, puede dirigirse a nuestro Oficial de Privacidad, sin perjuicio de que también puedas acudir a las autoridades correspondientes.

  1. MECANISMOS Y PROCEDIMIENTO PARA REVOCAR SU CONSENTIMIENTO  

En los términos de la normativa aplicable, usted puede revocar el consentimiento que en su caso nos haya otorgado. Sin embargo, es importante que tenga en cuenta que no en todos los casos será procedente su solicitud, ya que es posible que por alguna obligación legal requiramos seguir tratando sus datos personales, lo anterior, conforme a la Ley de Datos.

  1. LIMITAR EL USO O DIVULGACIÓN DE LOS DATOS PERSONALES

Usted podrá limitar el uso o divulgación de sus datos personales enviando su solicitud a la dirección victor.vazquez@galcaenergy.com

En caso de que su solicitud resulte procedente, se le registrará en el listado de exclusión para la finalidad para la cual es aplicable la exclusión.

Se hace de su conocimiento que existen otros mecanismos para limitar el uso y divulgación de sus datos como son el Registro Público para Evitar Publicidad (REPEP) de la Procuraduría Federal del Consumidor (PROFECO). Usted puede consultar el portal de internet de dicho registro para obtener mayor información sobre los servicios que proporciona dicha dependencia.

  1. COOKIES

Al navegar en nuestro sitio nuestras “cookies” y “registro del servidor” recaban cierta información no personal. Dichos datos se recaban por el uso e interacción de nuestro sitio web, los datos incluyen Protocolo de Internet, sistema operativo, tipo de navegador, dispositivo móvil, así como la trayectoria que realiza dentro del sitio web.

Los datos son utilizados únicamente con fines estadísticos, relativas al tiempo que pasa en nuestro sitio, así como los sitios de terceros que lo llevaron a nuestro sitio, asimismo la información es utilizada para actualizar los perfiles de los usuarios.

Pursuant to the provisions of the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (Hereinafter, the “Data Privacy Law”), its Administrative Rules, the Privacy Notice Guidelines and other relevant provisions applicable to the use and possession of personal data, you are hereby notified of the following Privacy Notice (the “Privacy Notice”).

 

Galca Energy S.A.P.I de C.V. its subsidiaries and affiliates (all indistinctly “GALCA ENERGY” or “Responsible Party”) with address at Hegel 512, Polanco section IV, Miguel Hidalgo, ZIP Code. 11560, Mexico City as responsible of the processing of your personal data reiterates its commitment with the transparency, security and privacy of personal data.

 

Any information concerning an identified or identifiable individual upon being collected will be treated in accordance with the principles of legality, consent, quality, finality, information, proportionality, loyalty and responsibility.

GALCA ENERGY in order to carry out the purposes listed in section V and VI of this Privacy Notice, will collect the following personal data:

  3. E-mail address

The personal data collected may be reproduced in electronic or physical files.         

Pursuant to this Privacy Notice, the Company will not collect sensitive personal, financial or property data.

  1. PRIMARY PURPOSES OF PERSONAL DATA PROCESSING

GALCA ENERGY may use your personal data to fulfill several purposes, being the following:

  2. Internal reporting required in accordance with the object and purpose of GALCA ENERGY.
  3. Inform about changes in the services offered by GALCA ENERGY
  4. Create databases with administrative, organizational, business projections. As well as regulatory compliance purposes.
  5. Attend and follow up any complaint, question, comment, return or contact request you send to us.
  6. Send notices of changes in this Privacy Notice. 

 

  1. SECUNDARY PURPOSES OF PERSONAL DATA PROCESSING

In addition, GALCA ENERGY may process your personal data to carry out any of the secondary purposes mentioned below, which allow us to provide you with a better service:

 

  1. Send you information of an advertising, promotional, and/or informative nature and commercial prospecting of GALCA ENERGY in accordance with your interest and consumption preferences, as well as other brands and/or trade names including sending communications via e-mail, phone calls, short messages and physical, electronic and/or digital means;
  2. To carry out statistics, consumption and market surveys.
  3. Invite you, according to offer bases, to participate in tenders in relation to services, developments and projects and contact you through the different physical, electronic and/or digital means of communication. We inform you that, in the case that you participate in such activities, it may be necessary for GALCA ENERGY to treat your personal image through videos and/or photographs, for publication, through different physical, electronic and/or digital means of communication.

Send you informative notes of topics related with the electric industry, as well as legislative developments and updates on the subject.

  1. ARCO RIGHTS

As Owner of your personal data, you may exercise at any moment the rights of access, rectification, cancellation and opposition (hereinafter, “ARCO Rights”). It is important to mention that the exercise of each one of these rights is independent from each other, therefore, it is not necessary to exhaust one of them to exercise any of the others.

  1. Access Right. By exercising this right, you can know the information related to the processing we carry out with your personal data.
  2. Rectification Right. You can correct or modify your data in case that they are inaccurate or incomplete in order to guarantee that the information that we may have about you is accurate.
  3. Cancellation Right. You may request the elimination of your personal data when any of the assumptions contemplated occurred. For example, illegal treatment of the personal data, or when the purpose that motivated the collection or process of the data disappear. However, there are regulated a series of exceptions where this right shall not proceed.
  4. Opposition Right. Through this right you may oppose to the process of your personal data: (i) when the reasons are related to your personal situation, the processing of your personal data must cease except when a legitimate interest is accredited, or it is necessary for the exercise or defense of claims, or, (ii) when the purpose of the processing is digital marketing.
  5. Processing Limitation Right. You may request us to restrict the processing of your data (i) when the accuracy of the data is disputed, while we verify the request; (ii) when the processing is illegal, but you oppose to the elimination of the data and request the limitation of processing instead; (iii) when you are the one who needs them in case of a complaint; (iv) and even when you have objected to the processing of your data for the compliance of an obligation of public interest or for the satisfaction of a legitimate interest, that should be verified.  In these cases, we will only keep them for the exercise or defense of complaints.   

In order  to exercise your  ARCO Rights, you must submit an application (hereinafter, the “ARCO Application”), to GALCA ENERGY, to the attention of the Privacy Officer, to the following e-mail address: victor.vazquez@galcaenergy.com for his attention and follow up with the following information, documentation and specifications:

  1. The application must be filled in all fields clearly and with clear letter.
  2. Your name, address and e-mail address in order to communicate you the response of the ARCO Application;
  3. A copy of your identification (ID), passport or any other official identification.
  4. A clear and precise description of the personal data of which you want to exercise any of the ARCO Rights;
  5. Any document or information that will facilitate the location of your personal data.
  6. In the case of requesting a rectification of your personal data, you shall identify as well, the modifications to be made and provide documentation to support your request.
  7. If the application is submitted through a legal representative, you should include the power of attorney stating the powers granted for this process, or even, a proxy signed before two witnesses with their signature stamped and the signature of acceptance of the representative, including the name, signature, address and a photocopy of an official identification of each of the signatories.

The Privacy Officer will respond your ARCO Application, indicating the motives for his decision via e-mail within a maximum period of 20 (twenty) calendar days counted from the day that your ARCO Application was received. In the case the ARCO Application is answered in an affirmative or appropriate manner, the requested changes will be made within a maximum period of 15 (fifteen) calendar days. In case you request access to your personal data, GALCA ENERGY will inform you via e-mail the answer to your request, the means by which you will be given access to your information if appropriate. If necessary and for one-time only GALCA ENERGY may notify the extension of the deadlines referred to herein for a period equal to the original one.

GALCA ENERGY may deny (hereinafter, the “Refusal”) for you to exercise your ARCO Rights according to article 34 of the Data Privacy Law, in any case, the Privacy Officer is responsible to inform you of the reasons of such decision. 

The Refusal may be partial, in which case GALCA ENERGY will provide the access, rectification, cancellation and opposition of the Owner. 

In case you consider that we have processed your data in an inadequate manner according to the regulation regarding the treatment of personal data or you are not satisfied with the way we have attended the exercise of your rights, you may contact our Privacy Officer, without restricting the fact that you may also attend before the corresponding authorities and file a claim.

  1. MECHANISMS AND PROCEDURE TO REVOKE YOUR CONSENT

According to the applicable regulation, you may revoke the consent that you may have given to us. However, it is important for you to know that not in all cases your request will proceed, since it is possible that due to some legal obligation, we may need to continue processing your personal data, in accordance with the Data Privacy Law.

  1. LIMITATION OF USE OR DISCLOSURE OF PERSONAL DATA

You may limit the use or disclosure of your personal data submitting your request via e-mail address to  victor.vazquez@galcaenergy.com

 

In case your request is appropriate, you will be registered in the list of exclusion with the purpose for which the exclusion is applicable.

 

We inform you that there are other mechanisms to limit the use and disclosure of your personal data such as are the Public Registry to Avoid Publicity (REPEP by its acronym in Spanish) of the Federal Consumer Protection Agency (PROFECO by its acronym in Spanish). You may consult the website of the registry to obtain more information on the services provided by these agencies.

  1. COOKIES

When browsing our website “cookies” and “server logs” collect certain non-personal information. Such data is collected for the use and interaction of our website, the data include Internet Protocol, operating system, browser type, mobile device, as well as the path you take within the website.

The data is use only for statistical purposes, relating to the time spent on our website, as well as third party sites that led you to our site, also the information is used to update user profiles.
